Terms and Conditions of Sale

1. Introduction

These General Conditions of Sale govern the online purchase of products offered on the site www.midras.it (hereinafter “Site”) owned by MIDRAS Srl., with registered office in Via Durazzo 2/C – 70054 Giovinazzo (BA), VAT number 09021650727, contact email: info@midras.it (hereinafter “Midras” or “Seller”).

The purchase of products through the Site implies full acceptance of these Conditions of Sale by the customer (hereinafter “Customer”).

2. Object

Midras markets cosmetic products, including Face and neck creams, wrinkle treatment serums, and skin care products.
These conditions regulate the sale and delivery of these products in Italy via the Site www.midras.it.

3. Registration and purchase

To make purchases, the Customer can proceed as a guest, without needing to register.
It is the Customer's responsibility to provide truthful and up-to-date information.
The Seller is not responsible for any delivery errors due to incorrect information provided by the Customer.

4. Prices

All product prices indicated on the Site are expressed in euro (€) e include current VAT.
Shipping costs (in ITALY) are included in the price of the products.

5. Payment methods

Midras accepts the following payment methods:

Credit/debit card (Visa, Mastercard, etc.)
Stripe
PayPal
Advance bank transfer

In the case of payment by bank transfer, the order will be processed only after the payment has actually been credited to the Seller's account.

6. Shipping and delivery

Shipments are made via express courier.
Average delivery times vary from 3 to 10 business days,

except in cases of force majeure or holidays.

The shipping cost varies depending on the destination and weight of the order, from €5 to €15, and it is at the customer's expense, unless otherwise indicated on the Site.

Midras is not responsible for delays or disruptions attributable to the courier.

7. Product availability

All products offered on the Site are generally available.
In the event of unavailability, even temporary, the Customer will be informed via email and will be able to choose between:

waiting for the new availability,
replacement with another product,
or a full refund of the amount paid.

8. Right of withdrawal and return of products

Pursuant to art. 52 of the Consumer Code (Legislative Decree 206/2005), the Customer has the right to withdraw from the contract within 14 working days from the date of receipt of the products, without obligation to provide reasons.

Withdrawal procedure:

The Customer must send a written request for withdrawal to info@midras.it, indicating the order number and the products you wish to return.
Midras will communicate the return instructions.

Le Return shipping costs are the responsibility of the customer.
The refund will be made within 14 days of receiving the returned products, using the same payment method used for the purchase.

⚠️ Exceptions:
For health and hygiene reasons, it is not possible to return products already opened, used or without original sealed packaging.

9. Warranties

The cosmetic products offered by Midras are not subject to a conventional guarantee, as they are non-durable consumer goods.
Any obvious defects must be reported within 7 days from receipt of the product to info@midras.it, attaching photos and a description of the problem.
Midras will evaluate the case and may, at its discretion, arrange for the replacement or refund of the product.

10. Responsibility

Midras will not be responsible for:

any damage resulting from improper use of cosmetic products;
skin or allergic reactions due to ingredients in the products;
interruptions or malfunctions of the Site;
delays or impossibility of delivery due to force majeure.

The Customer is advised to read the following carefully: list of ingredients before using the products.

11. Protection of personal data

The processing of personal data takes place in compliance with the EU Regulation 2016/679 (GDPR) and Italian legislation on privacy.

12. Applicable law and competent court

The sales contract is governed by the Italian law.
For any dispute relating to the interpretation or execution of the contract, the competent court shall be the consumer forum (place of residence or domicile of the Customer).
For professional customers (VAT number), the competent court will be that of Bari.

13. Changes to the conditions

Midras reserves the right to modify these Conditions of Sale at any time.
The changes will be effective from the date of publication on the Site and will apply only to subsequent orders.
